1. Introduction

At TraceWell, we empower you to make informed decisions about your water, air, and product consumption. This Privacy Policy explains how we collect, use, and protect your personal information when you use our website, app, or services worldwide.

Our services are not directed to children under 16, and we do not knowingly collect their data without verifiable parental consent. If you're under 16, please contact support@tracewell.app to arrange parental consent.

We comply with global data protection laws, including the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and Brazil's Lei Geral de Proteção de Dados (LGPD).

2. Information We Collect

We collect the following information to provide and improve our services, including water quality, air quality, and product contaminant insights:

  • Account Information: Name, email address, and password when you register.
  • Location Data: Precise or approximate location (e.g., ZIP code, geolocation) to generate water and air quality reports, sourced from utilities, sensors, or public databases.
  • Product Scan Data: Barcode data, product details, or user-submitted information when you scan products for contaminant analysis (e.g., microplastics, chemicals), sourced from third-party databases or lab reports.
  • Communication Preferences: Preferences for newsletters or support inquiries.
  • Device and Usage Data: IP address, device type, browser, and app interactions (e.g., pages visited, scans performed) to enhance functionality and analytics.
  • App Store Data: Data provided via Apple App Store or Google Play (e.g., account IDs) for subscription management, subject to their privacy policies.

Data Accuracy Disclaimer: Product, water, and air quality data are sourced from third parties (e.g., utilities, labs) and may not be complete or fully accurate. Our added insights (e.g., metric conversions, health impact analysis) are for informational purposes only and should not be relied upon as professional advice.

You can choose not to provide certain data (e.g., precise location), but this may limit access to features like localized reports or product scans.

3. How We Use Your Information

We use your information to empower you with environmental insights and ensure a seamless experience:

  • Deliver Services: Generate water and air quality reports, process product scans, and provide insights (e.g., contaminant health impacts, metric conversions) based on third-party data.
  • Personalize Your Experience: Tailor reports and recommendations based on your location or scan history.
  • Improve Our Platform: Analyze usage and scan data to enhance features and accuracy.
  • Communicate with You: Send service updates, respond to inquiries, or share newsletters (if you opt in).
  • Comply with Laws: Meet legal obligations, such as responding to regulatory requests.

Informational Use: Our reports and insights, including product contaminant data, are provided "as is" and are not guaranteed to be accurate or complete. They are not a substitute for professional testing or advice.

Legal Basis for Processing (EU/UK Users): We process data based on (a) your consent (e.g., newsletters, precise location), (b) contract performance (e.g., delivering reports), or (c) legitimate interests (e.g., analytics for service improvement).

4. Data Sharing

We share your data only as necessary to provide our services, with:

  • Service Providers: Cloud hosting, analytics, and payment processors bound by strict data protection agreements.
  • Data Partners: Water utilities, air quality sensor providers, or product database providers for report and scan generation, using anonymized data where possible.
  • Legal Authorities: When required to comply with laws or protect our rights.

Product scan data is not shared with third parties unless anonymized for research or analytics. We never sell your personal information.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to improve your experience, such as remembering preferences or analyzing usage. Essential cookies ensure functionality, while non-essential cookies (e.g., for analytics) require your consent via our cookie consent pop-up.

You can manage or opt out of non-essential cookies through our consent tool or your browser settings. Learn more in our Cookie Policy.

6. Data Retention

We keep your data only as long as needed for the purposes outlined:

  • Account Information: Retained until you request deletion or your account is terminated.
  • Location Data: Kept for up to 1 year to support report generation, unless you request earlier deletion.
  • Product Scan Data: Retained for up to 2 years for analytics, anonymized after 6 months where possible.
  • Usage Data: Kept for up to 2 years to improve services.

To request deletion, visit your account settings or email support@tracewell.app. We'll delete your data within 30 days unless required for legal purposes.

7. International Data Transfers

  • Portability: Receive your data in a machine-readable format.
  • Parental Consent for Minors: If under 16, request consent verification for account use.

California Residents (CCPA): Request data disclosure, opt out of sales (we don't sell data), and avoid discrimination for exercising rights.

Brazilian Residents (LGPD): Confirm processing, request anonymization, or review automated decisions.

To exercise these rights, email support@tracewell.app. We'll respond within 30 days (or 45 for CCPA requests).

10. Data Breach Notification

If a data breach occurs, we'll notify affected users and authorities (e.g., within 72 hours for GDPR) as required by law, using email or in-app notifications.

11. Automated Decision-Making

TraceWell's water, air, and product quality scores and insights (e.g., contaminant health impacts, metric conversions) are generated by algorithms for informational purposes only. These do not produce legal or significant effects and are not a substitute for professional testing or advice. We source data from third parties (e.g., utilities, labs), which may not be fully accurate or current. If we introduce automated decision-making with significant effects, we'll notify you and offer options to object or request human review.

12. Third-Party Links

Our services may link to external sites, such as water utilities or product databases. We're not responsible for their privacy practices or data accuracy. Please review their policies before sharing data.
